Rear brake sticking

I was on my way home from work yesterday stopped at a stop light... The rear brake did not release.. I was almost home(100 yrds) and pushed thru by reving the engine.. Once in my neighborhood I toyed around and discovered the brake lever was stuck down .. Touched it and it released .. What could cause this if my fluid is right ?

Yea do that and make sure the return spring is OK

my guess was the return spring that is located on the back side of the frame where the pedel pivots.. What pivot point are we talkin about ? (the return spring?)

Take it apart clean and lube it. Notice there's a cotter pin holding on the master cylinder linkage on the back of the pedal. Here's the Bike Bandit page cotter pin is #550.
