I need the help of the Bay Area KLR community, Please!

Hi all,

I'm having a terrible time with a dealership in Oakland. I purchased a brand new 2006 KLR from Bay area Motorsports on October 22 last year. I STILL have not recieved my registration or plates. Right before Thanksgiving I realized that something was wrong, and something was holding up my registration. I had to go to the DMV for my updated license, so I had them check the status. They said the dealership had not submited anything to them. I got home and called the dealership. After a few days, and another call, they finally told me that they sold a bike (not even a KLR) to a guy in Lafayette in April 2006 and they accidently wrote up the registration for his bike with MY VIN# and engine#! So now this guy in Lafayette has a bike with invalid registration and plates, and I have no registration or plates! I can't register the bike! I have called every week since the week before Thanksgiving and I am repeatedly told "we are tying to contact the guy, we will get back to you" but they never do call me back.

I went back to DMV today and had them fill out a VIN Verification form, so at least I can try to prove to an officer that it really is my bike, even though it is not registered. When DMV runs the VIN, it returns the other guys bike. DMV is calling Sacramento, but they said unless the guy in Lafayette comes in there is nothing they can do. They might end up cancelling his registration and isuing plates to me, but they said that would take an act of god, and would not be likely.

What can I do? Bay Area Motorsports has not done anything. I have called, and called. Lafayette is fairly close to Oakland... seems like they could do more to try and contact the other bike owner. We are both riding illegal bikes! Help!

Thanks,
triggerfish

The dealer "should" correct the problem, you may have to talk to a lawyer to fing the legal actions you could take. I think I might take the bike back to them and demand a NEW one with a title.

Today is the first day of the rest of your life.

SOME IDEAS

Personally if it were me, I'd call Kawasaki Corporate and relay the all the information to them. I think it would be up to them to them to put the pressure on the dealer to fix the problem, and real quick. You may need to fax in copies of your documents to Kawasaki to prove your information. Do not let the original copies of your dosc. get out of your hands. With out them you are basically in possession of a stolen bike.

I would get a lawyer to send them an "official" demand letter. I would think they would work a little harder to correct the problem. I had a similar problem with my sons bike

Good luck!

I still can't get over your willingness to travel from Kings Canyon to Oakland to buy a KLR. Surely there's a Kawasaki Dealer in Fresno?

Yep, that sounds like a plan, take the bike back and have them give you an '07, let them deal with a bike they can't get registered, and file a complaint with the BBB and the dealers local chamber of commerce, show them the letters though before you submitt them. Then spend the bucks and take out an add in the local paper telling about the problem, bad press has a way of getting things done when it comes to affecting their sales.

Hi all,

I think the dealer may have read this forum. I did, afeter using some strong language, get him to actually go to the other bike owner's house with the paperwork. The guy is in Hawaii till the 28th. The dealer said they would return to his place on the 29th with the whole package of things to be signed. That way he will have a legal registration that matches his VIN, and engine#, and I can actually get this thing registered for myself. I'm OK with that plan. The dealer seemed very eager to get this resolved this time, but if it does not happen on that day I'm going ahead with legal action, and pressing the DMV to go through with cancelling his registration, and complaints filed about the dealer with the DMV and BBB.

Thanks for all the great suggestions.

You are a patient person. I agree with Larryboy. Show up at the dealership with a backpack full of food and water, cellphone with extra batteries, important telephone numbers (radio stations included), documentation of you contacting them, and refuse to leave until it is resolved. Bring your KLR and yes they might be willing to trade for another KLR that is registered properly.

Is this the dealer that sells OTD prices? If so, their mothership is in southern California and you might want to contact them and explain your situation. I am guessing a manager might get his ass handed to him by days end.

Did the other guy buy a KLR also ? if he didn't, you'd have thought the DMV would have caught the problem.
